Sapo Terms and Conditions of Use (Updated)

1.1 Description of Sapo

Sapo is a social platform designed for university students in Latin America, that allows users to share thoughts, opinions and news anonymously within their university community.

1.2 Age Requirement

By registering on Sapo you confirm that you are 18 years of age or older. If you are under 18, you are not allowed to use the platform.

1.3 Acceptance of Terms

The use of Sapo will imply the tacit acceptance of these Terms. If you use Sapo you undertake the obligation to comply with them. Do not use the Platform if you do not agree with these Terms.

2.1 Account Registration

• To access Sapo you must register with a valid and verified university email address
• In addition, you must provide a telephone number, your age and accept our privacy notice
• You are responsible for maintaining the confidentiality of your login credentials and all activities carried out through your account
• You must notify us immediately of any unauthorized use of your account

2.2 Anonymous Publication

Anonymous postings are possible on Sapo but are subject to our community guidelines as well as these Terms. Users must behave ethically and respect others in their interactions.

2.3 Prohibited Content

It is strictly forbidden to publish:

• Personal data or personally identifiable information (PII) of third parties
• Content involving harassment, abuse, intimidation or violence
• Unlawful, obscene, defamatory, or threatening content
• Explicit sexual content or nudity
• False or misleading information
• Spam, unauthorized promotions or advertising

3.1 Moderation

User-generated content is subject to these Terms. We reserve the right to remove postings that violate these Terms.

3.2 Consequences for Violations

• First violation: removal of content
• Second violation: formal warning
• Third violation: three-day suspension
• Continued violations: permanent account suspension

4.1 Data Usage

We collect data on interactions and behavior within the app to improve the user experience.

4.2 Third Party Data Sharing

This data may be shared with third parties for marketing and research purposes, always in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (Ley de Protección de Datos Personales en Posesión de los Particulares) ("LFPDPPP"). 4.3 Privacy Protection

• We value the anonymity of our users.
• We will not disclose personally identifiable information (PII) unless required by law.
• Our privacy notice outlines our practices regarding the processing of your personal data, in accordance with the LFPDPPP.

4.4 Data Transfer to Third Parties

• Anonymized data may be shared with third parties, but personally identifiable data will not be shared.
• Users can limit certain data processing options through settings in the app.

5.1 User Generated Content

• Users retain ownership of their content.
• By posting on Sapo, you grant Sapo a non-exclusive, royalty-free, global license to use, modify and distribute such content.

5.2 Intellectual Property of Sapo

• Sapo, its design and technology are owned by the company.
• Duplicating, reverse engineering or infringement of intellectual property rights is prohibited.

6.1 Local Regulations

Sapo operates in compliance with applicable privacy and content laws in Mexico, including the LFPDPPP and the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).

6.2 User Responsibility

Users are responsible for ensuring that their content complies with local laws. Sapo is not responsible for illegal activities carried out by users, nor for any damage or loss resulting from a breach of these Terms.

In the event that the user carries out any action, conduct or use of the application that constitutes a violation of criminal law, he/she shall be solely responsible for the legal consequences arising therefrom. Sapo reserves the right to cooperate with the competent authorities in the investigation of any illegal activity.

Users are obligated to indemnify and hold Sapo and its affiliates harmless against any and all damages, claims, losses, liabilities, and expenses (including, but not limited to, reasonable attorneys' and consultants' fees) that are imposed on or incurred by Sapo and/or its affiliates, arising from, connected with, or related to any breach of these Terms by the users.

7.1 Service Availability

• Sapo does not guarantee continuous and uninterrupted access to the platform.
• We reserve the right to suspend services for maintenance or upgrades.

7.2 Content Liability

• Sapo is not responsible for the content generated by users.
• In the event of legal disputes, we reserve the right to take any legal action and will cooperate with the authorities as necessary.
